Accident at work place due to employer’s negligence

Every employer owes a duty of care to the employee. By law, the employer is under a legal duty to ensure the safety of the employee at workplace. The employer must eradicate all foreseeable risks and take reasonable steps to provide a safe and sound workplace environment. If the employee is injured at work place due to the fault of the employer who has failed to take precautions in preventing the injury; the employer will be liable to pay compensation to the employee.

Slips, trips and falls at workplace due to the fault of the employer

1. Poor housekeeping:

The employer is negligent about maintaining a good housekeeping. The workplace in not cleaned on daily basis, the rubbish or waste products are not thrown away and piled up for weeks or months or broken or spilled items are lying around etc. If the floors are not cleaned properly or objects are lying around on the floor this may cause a slip, trip or fall of the employee. 2. Unsafe stairs and ladders:

Stairs and ladders have a common use and cannot be avoided. A slip, injury or fall on the stairs can result in serious injury or death of a person. The employer is aware of the broken handrail or missing steps of the staircase and fails to get it fixed or a wrong type of ladder is placed which causes a slip, trip or fall of the employee.

3. Greasy, uneven and cracked surfaces:

When the floors at workplace are not cleaned, dried or dusted properly or floor texture is of poor quality or there are deep cracks and crevices on the floor. The floors are poorly maintained which causes a slip, trip or fall of the employee.

4. Poor lighting:

The workplace is not well lit or the switches are not easily reachable which causes a slip, trip or fall of the employee.

5. Obstructions across the walkways:

Unused items lying on the floor or work equipment lying around on the floor due to lack of storage and space or wire, cables running across the floors or torn rugs or carpets with uneven edges which causes a slip, trip or fall of the employee.

Accident at work claims and compensations

According to the Safety, Health and Welfare at Work Act 2005, the employer is under a legal duty to create and maintain a healthy and safe workplace. They must take reasonable steps to eradicate or prevent any risks that may cause injury to the employee. If the employer fails to comply with the duty under the 2005 Act, the employee can successfully claim compensation from the employer for any injury caused as workplace due to the negligence of the employer.
