The Labour Court recently awarded our Client and Agency Worker EMcG, €25,000 in compensation and back-pay for being paid less than his fellow permanent employees in contravention of the Protection of Employees (Temporary Agency Work) Act, 2012.
You are protected against the following issues as an Agency Worker:
- You are entitled to the same basic working conditions as regular employees.
- You cannot be charged a fee for making arrangments for an individual’s employment under the Protection of Employees (Temporary Agency Work) Act 2012.
- An employer to whom you are hired out as an Agency Worker, should inform you of any vacancies to enable you to apply for that position.
- You should be treated no less favourably as an Agency Worker than you would be as a regular employee of the business you were contracted out to.
